An Indian passport is primarily a travel document and is not, by itself, proof of citizenship. That clarification came from a senior Ministry of External Affairs (MEA) official at the 14th Passport Seva Divas in New Delhi on 24 June 2026, as reported by Gulf News and Deccan Herald.
It raises an obvious question for the millions of Indian nationals in the UAE and the wider Gulf: if the passport that lets them cross borders doesn’t establish their citizenship, what does? The reassuring part is that nothing has actually changed — the official was restating a long-standing legal position, not announcing a new rule.
What the Ministry says
A passport attests the nationality of an Indian abroad, signalling to foreign immigration officers which country is responsible for the traveller. But in the strict legal sense, it is not a document that establishes citizenship.
This stems from the Passports Act, 1967 — the law the Passport Seva Divas marks. A passport is issued only to citizens, yet holding one does not, on its own, settle a person’s citizenship status.
Which documents prove citizenship?
India has no single document that conclusively proves citizenship for an ordinary resident. What you rely on depends on how you became a citizen — by birth, by descent, or through a formal legal process.
These are the documents that actually help establish Indian citizenship, and who each one applies to:
- Birth certificate — the foundation for anyone who is a citizen by birth. On its own it is usually enough only for those born in India before 1 July 1987.
- Parents’ citizenship documents — needed alongside your own birth certificate if you were born in India on or after 1 July 1987, because citizenship then depends on a parent’s status. They also support a claim made by descent.
- Birth registered at an Indian mission abroad — for those born outside India to an Indian parent (citizenship by descent). The consular birth registration, together with the parent’s citizenship proof, is the key record.
- Certificate of Registration — for people who acquired citizenship by registration under Section 5 of the Citizenship Act, 1955, such as certain persons of Indian origin or spouses of Indian citizens.
- Certificate of Naturalisation — for foreigners who became citizens after long-term residence under Section 6 of the Act.
The two certificates are issued by the Ministry of Home Affairs through the Indian Citizenship Online portal and are the most definitive proof available.
For citizens by birth, the date you were born in India changes what you need:

Why it drew attention
Indians often assume everyday identity documents double as proof of citizenship. They generally do not. Aadhaar, voter IDs and PAN cards are proof of identity or residence — not nationality.
The courts agree. On 12 August 2025, the Supreme Court held that Aadhaar could establish identity but not citizenship during the revision of Bihar’s electoral rolls. On 27 May 2026, it upheld that revision but clarified that the Election Commission may examine citizenship only to decide voter-roll eligibility — a check that is not a final declaration of citizenship.

The remark came at the 14th Passport Seva Divas. External Affairs Minister Dr S Jaishankar, who heads the MEA, marked the day on X, praising the upgraded Passport Seva Programme and new chip-enabled e-Passports — though his message focused on service upgrades, not the citizenship question. For everyday travel, the e-passport is as valuable as ever. For questions of citizenship, though, Indians may need their birth and family records rather than the booklet in their pocket.
