Schengen Visa Scams and Fraud: What Counts, and the Penalties If You Did Not Know (2026)

Last updated: Sep 25, 2026

Check Your Situation: Was It Schengen Visa Fraud, and What Happens Now?

Based on EU visa law and each country’s own law and visa pages, checked 25 September 2026. Fines in EUR, CHF for Switzerland. General guidance, not legal advice.

Refused, even if you did not know

A forged bank statement, job letter or invitation in your file gets the visa refused, whoever made it.

You did not knowRefusal, or cancellation of a visa already issued. Usually not a crime, because the law punishes knowing use.You knewA crime in every country belowRecordThe refusal and its reason stay on the EU visa database for up to 5 yearsWhat to do

Get originals from your bank and employer yourself, then appeal or reapply with them and explain what happened. Keep proof of what you paid the fixer.

Counts as a false document

A hotel booking that was never made, or was cancelled before the consulate checked, counts against you.

You did not knowRefusal. Denmark’s consulate in the UAE says it refuses these files daily. Also caughtFlight plans with flight numbers that do not exist, and insurance in someone else’s nameWhat is neededA genuine reservation. You do not need a paid ticket. What to do

Make your own refundable reservations and keep them live until you have your decision. Avoid any site selling “dummy tickets”.

You are the victim

Visa appointments are free. Paying a middleman for one is not a crime by you, but you may lose the slot.

YouNo penalty for the payment itselfThe riskTLScontact says a bought slot may not be honoured at the centreWatch forA “guaranteed visa” package usually comes with fake papersWhat to do

Book only on the official visa centre’s own site. VFS Global says it does not work with any third party. See our guide to full Schengen appointment calendars.

Do not travel on it

A Schengen visa only comes from an embassy or consulate. One handed over by an agent should be treated as fake until the consulate confirms it.

You did not knowYou are a victim of the sale, but travellers found with fake stickers at Islamabad and Delhi airports were handed to policeOnce you knowUsing it is using a forged document, a crime in every country belowWhat to do

Ask the consulate named on the visa to confirm it before you fly. If it is fake, report the seller and keep every receipt and message.

Misstating your purpose

A Schengen visit visa does not allow work. Applying as a tourist to take a job is a false statement on the form.

You did not knowRefusal, because the stated purpose is not reliable. German missions say employment is not permitted on a Schengen visa. The offerA “Schengen work visa” does not exist. A real job needs that country’s own work visa. What to do

Check the recruiter is licensed: on eMigrate in India, or with the Bureau of Emigration in Pakistan. A real employer applies for your work permit, not a travel agent.

You are the victim

Someone posing as VFS, TLScontact, BLS or an embassy took your money. That is theft, and you did nothing illegal.

YouNo penalty, and no effect on a genuine applicationThe tellVFS never asks for payment by email, SMS or phone callWhat to do

Report it to your police cybercrime service, and to the real centre on the VFS fraud page or BLS at [email protected].

Most Schengen visa fraud that reaches ordinary applicants starts with an agent. The consulate judges the file, not who assembled it, so a fake paper means refusal even if you never saw it. Prosecution is different: all six countries here punish only knowing use.

Real rules against scam promises

What you are told The real rule
“Pay us for an appointment” Appointments are free, booked on the visa centre’s own site
“Guaranteed visa” Only the consulate decides, and paying an agent does not raise your chances
“The visa costs EUR 300” EUR 90 for adults, EUR 45 for children aged 6 to 11, free under 6, plus the centre’s service fee
“We will arrange your bank statement” Only your bank can issue it. A made-up one is forgery in your name.
“Apply online for a Schengen e-visa” There is no Schengen e-visa yet. Visas come only from embassies and consulates.

Questions

Can I be banned from Schengen for documents my agent faked?

A refusal is not a ban. An EU entry ban comes with a return decision, and a Schengen alert needs a national decision after looking at your own circumstances. A past refusal must not lead to an automatic refusal next time, so an honest new application is judged on its own.

Will other Schengen countries see my refusal?

Yes. The refusal, with its reason, is stored in the EU visa database for up to five years, and every Schengen consulate checks it. If you win an appeal, the refusal must be deleted. Our Schengen visa rejection guide explains each refusal reason.

Can I go to prison for Schengen visa fraud if I did not know?

In all six countries covered here, a crime needs intent, so an applicant who truly did not know is not criminally liable as the law is written. Two cautions: Swiss law treats suspecting a fake and going ahead as intent, and police in Mumbai opened a case against applicants after a complaint from the German consulate. Proof that you were deceived matters.

How much does a Schengen visa cost in 2026?

EUR 90 for adults and EUR 45 for children aged 6 to 11, while children under 6 pay nothing. These fees have applied since 11 June 2024. Visa centres such as VFS may add a service fee on top. A quote far above that is a warning sign.

Where do I report a fake Schengen visa agent?

In Pakistan, the FIA takes complaints at complaint.fia.gov.pk or on 1991. In India, report money lost at cybercrime.gov.in or on 1930, and an unregistered job recruiter to the MEA. In Dubai, use Dubai Police’s eCrime service. In Saudi Arabia, use the Interior Ministry’s Kollona Amn app.

How this checker was put together
  • The outcome for each situation comes from the Visa Code: Article 32(1)(b) requires refusal where there are reasonable doubts about the authenticity of supporting documents, with no test of what the applicant knew. Article 34 requires annulment of a visa obtained by fraud.
  • The five-year record is the VIS retention period under Article 23 of Regulation 767/2008, counted from the refusal decision. A refusal is not an entry ban: under the Return Directive a ban accompanies a return decision, and a SIS refusal-of-entry alert needs an individual assessment.
  • Each country’s “crime” row is the national provision closest to using false documents to obtain a visa, with its maximum penalty as written. Courts sentence within those ranges. The “needs” row cites each penal code’s general intent rule: StGB section 15, Code pénal 121-3, Codice penale 42, Código Penal 5, 12 and 14, Wetboek van Strafrecht 225(2), and Swiss StGB 12.
  • Appeal routes are those in force on 25 September 2026. Germany ended remonstration worldwide on 1 July 2025. France moved short-stay appeals from the Commission de recours to the sous-direction des visas from 1 January 2023.
  • Not covered: national long-stay visas for study or work, and the court stage after a Dutch objection or a French ministry appeal. Appeal fees for France, Spain and the Netherlands could not be confirmed and are not stated.
