How to Spot a UAE Visa Scam
- You are asked to pay for a work visa. UAE employers cannot charge workers recruitment costs.
- You are told to come on a visit visa and switch. MOHRE warns that a visit visa is not a work visa.
- The offer is too good. High pay and instant hiring, with fees or bank details asked for up front, are MOHRE’s named warning signs.
- A caller or website uses ICP’s name. ICP says to apply only through its smart services or the UAEICP app.
Questions
Can I get in trouble for visa fraud in the UAE if I didn’t know?
Often, yes. The Penal Code says ignorance of the law is no excuse, and a person is liable for mistakes as well as intent unless an article requires intent. Using a forged document is the main exception: it is only a crime if you knew it was forged.
Is a “free visa” legal in the UAE?
No. When MOHRE finds a worker registered with an employer that does not really exist, it cancels the permit and can take action against the worker and the employer. The legal options for working independently are MOHRE’s own freelance and part-time permits.
Can my employer keep my passport in the UAE?
No. The Labour Law says an employer must not withhold a worker’s official documents, and domestic workers have the right to keep their own ID. If yours is being held, ask for it back and file a complaint with MOHRE if you are refused.
What should I do if an agent sold me a fake UAE visa?
Do not travel or work on it. Check it on ICP’s File Validity page, or on GDRFA Status Tracking if Dubai issued it. If there is no record, or the details do not match your passport, treat it as fake. Then report the agent: Aman on 8002626 in Abu Dhabi, or 901 in Dubai. Online visa fraud carries at least a year in prison.
Is overstaying a visa in the UAE the same as visa fraud?
No. Overstaying is an administrative fine of AED 50 a day, paid to ICP, and it only becomes a criminal matter if the fine goes unpaid. See our UAE overstay fine guide for how past waivers worked.

How this checker was put together
- Every penalty is read off the law text on the UAE Legislation portal, in English and Arabic, retrieved 25 September 2026. Where the two differ, the Arabic is treated as authoritative.
- “If you didn’t know” rows rest on the Penal Code’s general rules, which apply to other penal laws. Article 43 says ignorance of penal law is no excuse, and Article 44 makes a person liable for error unless an article expressly requires intent. Under Article 40, a mistake of fact only helps if the belief was reasonable and checked. Article 24(2) of the residence law is the one visa offence that expressly requires knowledge.
- Article 25(8) gives a written “did not know” defence only to farm and estate owners. For other landlords and employers, checking a person’s documents is the practical precaution, not a guaranteed defence.
- No article sets a penalty for a worker who works for a non-sponsor. The “free visa” row relies on Ministerial Resolution 47 of 2022, Article 5, and residence law Article 27. No official source was found treating a “free visa” worker as a victim.
- The penalties table lists the maximum or range the law sets for each offence. Courts decide the actual sentence, and prison terms given only as a maximum carry the Penal Code’s own minimums.
- The visa-check guidance in the fake-visa answer follows the fields shown on ICP File Validity and GDRFA Status Tracking, checked 25 September 2026. Treating a missing or mismatched record as a fake is our advice. GDRFA handles Dubai-issued visas and ICP the other emirates.
- The scam signs come from ICP’s own site and the Labour Law, plus MOHRE warnings as reported by Gulf News. The “what to do” advice on lawyers and reporting is ours, not an official procedure.
- Amnesty: ICP’s airspace-closure waiver ended with a grace period on 9 July 2026, and ICP’s site showed no open scheme on 25 September 2026.
- Known limits: this is general information, not a legal assessment of your case. Courts decide the actual outcome.
